TERMS AND CONDITIONS
The Polar Travel Company strongly advises that all travelers carefully read these Terms and Conditions, as all rights and obligations between The Polar Travel Company and each client will be governed by these as here described.
The Polar Travel Company acts as an intermediary between the client and the Operator (this refers to said company and all Manager of the vessel, Owners, Operators, Charter companies, Sub-Charter companies, crew and staff of the vessel), hotels, transportation, guides, and any other member or company related with the services and or tours.
GENERAL BOOKING TERMS
The following booking terms will apply in case of a regular booking, i.e. individuals or groups; in case of a charter (booking of the entire trip and vessel) specific booking terms will have to be negotiated and agreed upon.
PAYMENT, DEPOSIT, AND CANCELLATION PROCEDURES
All rates are quoted per person in US Dollars as indicated, based on the indicated booking occupancy.
A deposit of 40% per person is required to confirm a reservation.
Final payments remain due 120 days prior to departure and once paid are non-refundable. Failure to do so will liberate the booking for sale to another client and the booking fee will not be refunded.
The Personal Medical Information form duly filled and signed by the client should be received by The Polar Travel Company no later than 120 days prior to departure date.
The payment of a deposit of any part or full payment for a reservation on this tour shall constitute consent to all the provisions contained herein. In case of cancellation, you must notify The Polar Travel Company.
THE FOLLOWING TERMS WILL APPLY
If cancellation notice is received up to 160 days prior to departure, deposits are refundable, less a 25% of the total amount as cancellation and administrative fee per person (please note that with some operators all payments are non-refundable).
If cancellation notice is received between 159 and the day of departure, deposits are non-refundable.
If payments are not received by the dates specified above, The Polar Travel Company reserves the right to cancel a booking and withhold return of all payments received, unless a change in the payment schedule has been agreed upon by The Polar Travel Company.
The Polar Travel Company shall not be liable for any special or consequential damages, whether known or unknown, neither for any costs of air ticket, hotel or similar expenses that the client may have incurred in, under any circumstances whatsoever, apart from those included in the agreed upon itinerary.
The Operator/Manager of the Vessel reserves the right (in its sole and absolute discretion) to reschedule the departure and return of any expeditions or program at any time, as conditions warrant, and without prior notification and no further obligation on our part.
The Polar Travel Company strongly suggests to all of its clients to purchase trip cancellation and interruption insurance as protection against an emergency which may force you to cancel or leave an expedition or program while it is in progress.
Please note that all dates and rates are subject to change. We reserve the right to amend our prices. It could alter in the event of significant surface increases and/or marked fluctuations in the exchange rate upon which the land content is based or massive fluctuations in the fuel costs on which the cruise is based, among other reasons. Any increases in price must be paid by the client before the departure date.
Voyage aboard the indicated vessel as indicated in the itinerary; All meals throughout the voyage aboard the ship including snacks, coffee and tea; All shore excursions and activities throughout the voyage by Zodiac or other means of transport; program of lectures by noted naturalists and leadership by experienced expedition staff; All miscellaneous service taxes and port charges throughout the program; pre-departure material.
Any airfares and transfers, unless specifically mentioned; pre and post land arrangements; passport and visa expenses; Government arrival and departure taxes; meals ashore; baggage, cancellation and personal insurance (which is strongly recommended) medical insurance (which is mandatory); excess baggage charges and all items of a personal nature such as laundry, bar, beverage charges (unless specified) and telecommunication charges; and the customary gratuity at the end of the voyages for stewards and other service personnel aboard.
DELAY OR CHANGE OF ITINERARY
Our offered trips are expeditions to remote parts of the world and the Operator/Manager of the Vessel reserves the right to change the itinerary due to weather conditions, availability of anchorages, wind conditions, political conditions and other factors beyond our control without consulting the clients. The operator and or the ship's master may for any reason change the date of departure or conclusion of the tour, the scheduled point of departure for the tour, omit or change any scheduled stop on the tour or change the scheduled place of conclusion for the tour whether before or after the tour has departed, without prior notice to you. You will have no right to any refund and The Polar Travel Company, Operator, or the charter company of the vessel will have no obligation to you or be liable for any loss, consequential damages, expenses, loss of time, or enjoyment or inconvenience in respect of such changes. The Polar Travel Company reserves the right to cancel any tour prior to departure, for any reason, in which case any payment made by you will be refunded in full and you will not be entitled to make any further claim for compensation or damages, for any loss, consequential damage, expenses, loss of time or inconvenience which may result from such cancellation.
By confirming the booking by, either email or by signature as set forth on the booking form, the client also acknowledges and confirms the following:
The client waives any and all claims he/she may now and in future has against, and release from all liability and agree not to sue The Polar Travel Company and its officers, employees, guides, agents or representatives (collectively its staff) or the licensor for any personal injury, death, property damage, or loss sustained by the client as a result of his/her participation in an adventure trip sold by The Polar Travel Company.
A tight time-schedule connection with an Antarctic or Arctic expedition is unwise. For this reason, The Polar Travel Company strongly suggests that a flexible air ticket be held for your journey home. In no case is The Polar Travel Company responsible for any expense or penalty incurred by the client deriving from a change in the ending date of the Travel Program.
Participants should understand that there are certain known and unknown hazards involved in such expeditions, which they must accept voluntarily at their own risk.
The Polar Travel Company strongly urges participants to check with their insurance agent to make sure that they are adequately covered for all eventualities. In case of a medical problem arising during the voyage, which results in costs for evacuation or repatriation, the responsibility for payment of these costs belongs solely to the client.
The Polar Travel Company strongly advises that clients ensure that such eventualities are covered by travel or medical insurance. If not covered by insurance, the responsibility still remains with the client and The Polar Travel Company specifically declines any responsibility whatsoever.
